Toowoomba 2007/2008: A Catholic school did not report abuse allegations against a teacher to police; he continued abusing and was convicted of 44 offences against 13 girls
In Case Study 6 the Australian Royal Commission examined a Catholic primary school in the Diocese of Toowoomba. In September 2007 parents reported that the teacher Gerard Byrnes had touched their daughter under her shirt. The principal did not report this to police, had the girl "demonstrate" the assaults on her father and left the most serious allegation out of a disciplinary letter. Byrnes even remained the school's student protection contact and after retiring in 2008 was re-engaged as a relief teacher. He was not arrested until November 2008. In 2010 he was convicted of 44 offences against 13 girls aged eight to ten, most of them committed during class.

How were they charged and sentenced?
- In September 2007 a father told the principal that Byrnes had put his hand inside his daughter's shirt. The principal did not report this to police. At a meeting the girl had to demonstrate the teacher's conduct by pretending that her father was Byrnes and showing with his hands where she had been touched. According to the commission, there was no basis for this. The principal and an officer of the education office minimised the allegations by leaving the allegation that he had put his hands down a girl's pants out of the disciplinary letter and taking no other action.
