The Karadima case: conviction and dismissal from the clerical state

In 2011 the priest Fernando Karadima of the Archdiocese of Santiago de Chile was convicted of abusing minors by the Congregation for the Doctrine of the Faith, at first instance in February and finally in June. The case shook the entire Church in Chile; in 2018 the Chilean bishops offered the pope their resignation. On 27 September 2018 Pope Francis dismissed the 88-year-old from the clerical state. The Vatican spokesman spoke of a "very serious case of rot" and of exceptional damage in Chile.

What happened to the people

Who was affected? Victims and numbers

  1. In the criminal proceedings it was established that Karadima had committed sexual assaults (abusos deshonestos) against James Hamilton, José Andrés Murillo and Juan Carlos Cruz; however, the proceedings were finally discontinued because of limitation. Murillo was the first to report the acts to the Church in 2003, with a letter to the then Archbishop of Santiago that went unanswered; a second letter followed in 2005.

How were they charged and sentenced?

  1. The Congregation for the Doctrine of the Faith convicted Fernando Karadima of abusing minors, at first instance in February 2011 and finally in June 2011.

  2. By decree of 27 September 2018, Pope Francis dismissed the 88-year-old Karadima from the clerical state, as an "exceptional decision" by virtue of his supreme authority (can. 331). The decree was served on him on 28 September.

  3. On 27 March 2019 the Court of Appeals of Santiago overturned the dismissive first-instance judgment of 2017 and upheld the damages claim of the three victims against the Church. The Church had acted negligently and inactively in investigating the reports and protecting the victims, in a way that could be described as cover-up in the civil law sense. The court did not, however, find a criminal cover-up proven; the breaches of duty were negligent, not criminal. At the conciliation hearing in November 2018 the archdiocese had admitted mistakes, such as having doubted the credibility of the reports.

What happened to those affected?

  1. The case had consequences for the entire Church in Chile; the Chilean bishops placed their offices in the hands of the pope. The Vatican spokesman Greg Burke spoke of a "very serious case of rot that had to be uprooted"; Karadima's serious crimes had caused exceptional damage in Chile.

Witness accounts and records

Witness A priest as a witness in the civil trial on the archdiocese's conduct

“el error, refiriéndose al Arzobispado, fue no decir que no sabía qué hacer, y haber pedido ayuda, porque si lo hubiera hecho, habría sido distinto, el drama fue que no lo hicieron y lo hicieron mal”

Translation (unofficial)

"The mistake, referring to the archdiocese, was not saying that it did not know what to do and asking for help, because if it had done so, things would have been different; the tragedy was that they did not do so and did it badly."

Corte de Apelaciones de Santiago (Chile), veröffentlicht von La Tercera: Corte de Apelaciones de Santiago, Urteil vom 27. März 2019, Cruz Chellew y otros con Arzobispado, N° Civil-Ant-4028-2017, Erwägung 39, PDF-S. 20. Original
From the case files Statement of the Archdiocese of Santiago at the conciliation hearing of 20 November 2018

"Fue un error dudar en un principio de la verosimilitud de las denuncias en base a criterios parciales y equivocados…”…“Fue un error no haber acompañado a las víctimas de Fernando Karadima de manera más efectiva y decidida durante el proceso de investigación, especialmente cuando sufrieron ataques injustos de personas del círculo de Karadima que cuestionaban públicamente su carácter, credibilidad e integridad personal".

Translation (unofficial)

"It was a mistake to doubt at first the credibility of the reports on the basis of partial and mistaken criteria ... It was a mistake not to have accompanied the victims of Fernando Karadima more effectively and decisively during the investigation, especially when they suffered unjust attacks from people in Karadima's circle who publicly questioned their character, credibility and personal integrity."

Background

Why? Justification and motives (according to the sources)

  1. According to the psychological report accepted by the court as evidence, the victims' disclosure threatened the perpetrator's circle, his public image and the reputation of the Church as an institution. The church leadership had rejected the reports and by its inaction protected the perpetrators as if they were the victims of slander.

Who received the assets, who profited?

  1. The court ordered the Church to pay each of the three plaintiffs 100 million pesos in damages for non-material harm, plus inflation adjustment and interest. Hamilton had demanded 200, Murillo 150 and Cruz 100 million. The amount applies only to the Church's own conduct, not to the abuse by Karadima himself.

„a James Hamilton Sánchez, $100.000.000.-(cien millones de pesos); a José Andrés Murillo Urrutia, $100.000.000.-( cien millones de pesos); y a Juan Carlos Cruz Chellew, $100.000.000.-(cien millones de pesos)“
